“fools rush in where wise men never go”.
In ruling that same – sex “marriage” should be identical under the Law to heterosexual marriage the five judges of the US Supreme Court who voted to strike down the Defense of Marriage Act (DOMA) are indicating that the philosophical paradigm within which they operate has at least the following characteristics :
1.Places ideology before truth and fact.
Ideologically the judges hold that the two types of unions should be regarded as identical under the law even though they are clearly neither equal nor identical.
Truth & Fact : male + female ≠ male + male ≠ female + female
Judges’ Ideology : male + female = male + male = female + female
2. Places no unique value on the role and functions of heterosexual unions in the society despite the obvious anatomical, physiological and psychological complementarity of males and females and millennia of human experience in all societies of the value of the heterosexual union for producing and and rearing children.
3. Places emotion above all other considerations in this legal judgment.
The very different heterosexual and same -sex unions are to be regarded as identical under the law not because they are known to be equally valuable to the society – the common good – but rather because in both cases two persons ” love each other”.
The judges failed to appreciate that the value of the heterosexual union to human civilization is such that heterosexual marriages have been and are still being arranged without reference to “love”
